Once approved, an employer's Shared Work plan is valid for one year from the date the application was received. Employees who are participating in the Shared Work program may receive benefits for up to 52 weeks. Instead, when faced with this situation, the company can retain its total workforce on a four-day-a-week basis. This reduction from 40 hours to 32 hours cuts production—and payroll—by the required 20 percent without reducing the number of employees.
All affected employees receive their wages based on four days of work. Each week, the employer makes sure that they are meeting the Shared Work program requirements and submits a certification form to KDOL verifying who is affected.

Have a reduction that affects a business unit of two or more employees. That application form is used to submit a new application for a Work-Share plan or to modify a plan that has previously been approved. The quickest method is by email to taxnet dwd. Plans can also be faxed or mailed into the department. Work-Share plans do require a list of the employees you would like to be participants in the plan.
You can submit the required employee information using the application itself or you can submit a list of participant employees in an Excel Spreadsheet. The earliest effective date for a Work-Share plan is the week beginning the first Sunday after the plan is approved by the department unless a later date is indicated on the application form. We do treat Work-Share applications as a priority and can generally process them within one week but this will be dependent upon the amount of applications being submitted and whether additional or clarifying information is needed. If you no longer need to have staff on a reduced work schedule and would like to preserve potential workshare weeks for future use, simply send an email to taxnet dwd.
You may submit more than one Work-Share plan if you have more than one affected work unit. Or you can submit one plan for all of a legal entity's employees. That is up to needs of each business but each Work-Share plan will be treated separately by the department.
This includes salary and exempt employees as long as their reductions also meet these conditions. Avoid financial hardships. A minimum of two employees and at least 10 percent of your regular workforce, or a department of the workforce, must be affected by a reduction in hours and wages.
Hours and wages must be reduced by 10 to 60 percent. Health and retirement benefits must stay the same as before, or they must meet the same standards as other employees who are not participating in Work Sharing. Affected work units to be covered by the Work Sharing plan, and each participating employee, must be identified by their legal name and Social Security number. All necessary reports and information are provided to the EDD. Leased, intermittent, seasonal, or temporary service employees cannot participate.
Corporate officers or major stock holders with investment in the company cannot participate. Work Sharing cannot be used as a transition to a layoff.
